NOTIFICATION Chapter IV Miscellaneous 1. Application for CPPs and Processing Thereof i) Application for new Captive Power Plants/Renewal of existing Captive Power Plants shall be submitted in triplicate in the prescribed format (Annexure-I), to the Secretary of the Commission, at the following address:-

Pradesh Electricity Regulatory Commission ii) Each application for CPP shall be accompanied by non-refundable application and processing fees as prescribed in Madhya Pradesh Electricity Regulatory Commission (Fees and Charges) Regulation, 2002 or as amended from time to time. iii) Application shall be accompanied by documents listed as enclosures to the application form. iv) Applications shall be disposed off by the Commission, within 3 months from the date of receipt of applications complete in all respect, except in case of CPPs of capacity higher than 25 MW. 2. General:- i) The CPP of total generating capacity upto 100 KVA shall be exempted from seeking permission of the Commission for installation. CPP will however ensure to inform the Utility prior to installation. ii) Permission to install captive power plant shall be given subject to the condition that actual user does not owe any amounts to Utility. iii) In case any person owing any amount to Utility intends to install captive power plants in the name of his family, company or under partnership then he shall be given permission only after payment of arrears and an affidavit shall be required from the applicant, in this regard. iv) Wheeling of electrical energy by the CPP owners for their own use shall be permitted from the captive power plants established within the State of M.P. The wheeling charges shall be determined by the Commission. v) If the CPP owner fails to abide by the direction and the guidelines of the Commission, the consent may be withdrawn at any time by giving notice. vi) For CPPs above 25 MW, case will be decided in consultation with Authority. Guidelines prescribed by Authority will be applicable in such cases. The applicant will provide any additional information that may be required by Authority. In such cases, consent shall generally be granted or withheld by the Commission within 30 days of receipt of the comments, of the Authority. vii) The consent for installation of CPPs or the Renewal consent shall generally be given for a period of 5 years. After 5 years the CPP Owners shall have to obtain renewal permission from the Commission. viii) The consortium based power generation plants may be permitted at the discretion if the Commission is satisfied about the need of the same. In such cases, the participants must enter into an agreement for captive generation and consumption. ix) All CPP owners shall obtain permission/approvals etc. required from Chief Electrical Inspector, Government of Madhya Pradesh in respect of electrical safety and all other statutory clearances/approvals from State/Central Government or their concerned agencies. x) Applications for power plants of capacity more than 25 MW shall be accompanied by Feasibility Report as per guidelines of authority. xi) Pending applications in the Commission shall be dealt in accordance with these Regulations. xii) The limit of capacity shall not apply to CPPs based on non-conventional energy sources (defined as per MNES) and co-generation plants and their permission may be considered for continuous operation. xiii) The Utility shall, within 30 days from the date of notification of these Regulations in the official gazette designate Officer/s (area-wise/district-wise) for the purpose of acceptance of application from CPP owners and shall notify their name, designation, office address and contact phone no. for submission of copy of the application for grant/renewal of consent. xiv) The Utility shall send its comments on affidavit to the Commission within 21 days from the receipt of the application. If no comments are received from the Utility within 21 days, it shall be presumed that the Utility has no objection to grant/renewal of consent and the Commission shall proceed to decide the matter.
