NOTIFICATION

Chapter I
General

1. Short title and commencement 

i) These regulations may be called the Madhya Pradesh Electricity Regulatory Commission (Grant of Consent to Captive Power Plants) Regulations, 2003. 

ii)These regulations shall come into force from the date of their publication in the official Gazette.

2. Definitions 

a) "Adhiniyam" means Madhya Pradesh Vidyut Sudhar Adhiniyam, 2000.

b) "Commission" means the Madhya Pradesh Electricity Regulatory Commission, constituted under section 3 of the Adhiniyam.

c) "Authority" means the Central Electricity Authority constituted under' section 3 of the Electricity (Supply) Act, 1948.

d) "Board" means the Madhya Pradesh State Electricity Board.

e) "Licensee" means a person licensed under Part V of this Act to transmit or supply electricity and shall include a person licensed under Section 3 or who has been given the sanction under Section 28 of the Indian Electricity Act, 1910 (No. 9 of 1910) prior to the coming into force of this Adhiniyam.

f) "Utility" means Board or Licensee.

g) "Captive Power Plant (CPP)" means the power plant set up/proposed to be set up by a person or a group of persons for his or their own use.

h) "Co-generation" means the installation in which two or more forms of useful energy (e.g. electric power & steam, electric power & shaft power etc.) are produced simultaneously.

i)"Regulations" means these regulations. 

j) "Consent" means the consent of the Commission envisaged under section 21(3) of the Adhiniyam read with section 44 of Electricity (Supply) Act, 1948.

3.         Words and expressions used but not defined in these Regulations but defined in the Adhiniyam shall bear the meaning as in the Adhiniyam. Words and expressions used in these Regulations but not defined either in Regulations or in the Adhiniyam but defined in the Indian Electricity Act, 1910 (No.9 of 1910) or the Electricity (Supply) Act, 1948 (No.54 of 1948) shall have the meanings respectively assigned to them in those Acts.
